By engaging with our Services, website, or making a purchase, you agree to the terms outlined in this privacy policy (the "Privacy Policy"). At TrainingMask ("TrainingMask," "we," "our," or "us"), we value your privacy rights and understand the importance of safeguarding your information. This Privacy Policy explains the types of personal data we collect from you, how we use it, and the choices you have regarding your information.

SCOPE

This Privacy Policy applies to the collection, use, and disclosure of personal information through our Services. It does not apply to any information collected outside of our Services.

"Personal information" refers to data that can be linked to a specific individual and could potentially identify that person, either from the data itself or in conjunction with other information that TrainingMask has or is likely to have access to. We do not consider personal information to include data that has been anonymized, pseudonymized, or aggregated in a way that it can no longer be used to identify a specific person, either on its own or in combination with other information.

"Services" refers to the goods and services offered by TrainingMask to the general public, including our websites (e.g., trainingmask.com) and the products and services sold through these websites.

COLLECTION

How We Collect: We may collect personal information when you use or access our Services, such as when you sign up for the Services or interact with us regarding your use of the Services.

Types of Information We Collect: The personal information we collect may include, but is not limited to, the following:

  • Identifying Information: This includes your name, shipping address, phone numbers, email address, device IDs, third-party user IDs, and other unique identifiers.
  • Financial Information: This includes your bank account and payment card details.
  • Electronic Network Activity Information: This includes usage statistics, page views, referral URLs, IP address, web log information, device information, browser settings, and information collected through cookies and similar technologies. TrainingMask uses cookies to track items in your shopping cart, including abandoned carts, and this information is used to determine when to send cart reminder messages via SMS.
  • Order Information: This includes your order billing and shipment address, as well as payment information.
  • Commercial Information: This includes your service subscription history.
  • Geolocation Data: This includes your postal address zip code.
  • Inferences: This includes information derived from how you use and interact with our services.

USE, RETENTION, AND CORRECTIONS

How We Use Personal Information: The personal information you provide is used to provide and improve our Services, personalize the Services for you, and enhance your user experience. This includes, but is not limited to, the following:

  • Displaying our website(s) or app(s) to you
  • Recommending products or services, product searches, and other shopping or ecommerce services
  • Order processing, shipping, and fulfillment
  • Payment processing
  • Customer service, including refunds and returns
  • Corresponding with you

Third-Party Usage: The personal information we collect may be combined with other personal information available from our records and other sources. Retention Duration:

We retain personal information as long as there is a reasonable basis to do so. This may include enforcing relevant laws, agreements, resolving disputes, or fulfilling business, tax, or legal purposes. When disposing of personal information, we do so securely.

Corrections: If you believe any personal information we have is incorrect, you may request a correction by contacting us at support@trainingmask.com.

YOUR CHOICES

Declining to Provide Information: You have the option to decline submitting personal information or disabling webpage cookies.

Effect of Declining to Provide Information: If you choose not to provide personal information or any portion thereof, it may result in a reduction in the quality of our Services. However, please note that any resulting inability to provide the Services or any degradation thereof shall not be grounds for any claim of breach, damages, or other liability, nor relieve you of your obligations to TrainingMask.

Requesting Your Personal Information:

You may request a copy of your personal information stored by TrainingMask. To do so, please email info@trainingmask.com with your request. We may take up to 30 days to provide the requested information.

Requesting Deletion of Personal Information: You may request that TrainingMask modify or delete your personal information stored by us. However, please note that doing so will relieve and release TrainingMask from any liability, obligation, claim, or damages related to or arising from said personal information.

LEVEL OF SECURITY

Security Measures: TrainingMask employs commercially reasonable measures in line with industry standards to protect your information. This includes electronic and administrative safeguards designed to secure personal information. We will make reasonable efforts to notify you in the event of a security breach.

DISCLOSURE

When We Disclose Personal Information: We may share personal information with third parties when necessary to provide the Services (such as vendors or advertising partners).

We may disclose personal information if we have a good faith belief that it is necessary by law or to respond to legal processes, protect the safety and lives of individuals, safeguard the rights or property of TrainingMask, respond to lawful requests by public authorities, meet national security or law enforcement requirements, or with your consent. Opt-in data and consent for text messaging will not be shared with any third parties.

Disclosure to Vendors: TrainingMask may engage the services of other companies to facilitate the provision of our Services. These companies will have access to personal information only as needed to perform their services, and we do not authorize them to use or disclose personal information for their own purposes. We have confidentiality agreements in place with these companies to ensure the same level of data protection. However, TrainingMask shall not be liable to you for any failure by these companies to adhere to the confidentiality terms.

California Residents. Under the California Consumer Privacy Act (as amended by the California Privacy Rights Act), or CCPA, California residents have certain rights regarding their data, including:
To know the categories of personal information collected and disclosed and the sources from which such information was collected (see Section 2.2);
The business purpose for using or sharing personal information (see Section 3.1);
The categories of third parties with whom personal information has been and will be disclosed (see Section 6.2); and
The ability to know and delete certain pieces of personal information (see below and Section 4).
Right to Know and Right to Delete. If you are a California resident, you shall also have the right to know the specific pieces of personal information that TrainingMask has about you; and to have TrainingMask delete said pieces of personal information at your request.

ADDITIONAL DISCLOSURES: EU RESIDENTS

Right to Know, Correct, Update, and Delete. If you are a resident of the EU, you shall have the right to know the specific pieces of personal information that TrainingMask has about you; and to have TrainingMask correct, update, and/or delete said pieces of personal information at your request.

OTHER.

Correcting Personal Information. You agree to notify TrainingMask of personal information that you are aware has errors.
Do Not Track. Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.
Changes. We reserve the right to make changes to this Privacy Policy at any time. Your continued use of our Services will signify your acceptance of any changes to our Privacy Policy.
If there is a substantive or material change in the way that we use personal information, we will notify you via email of the relevant changes or provide other prominent notice. Changes to the Privacy Policy will go into effect five (5) business days after notice of the change is posted on our website(s).
Third-Parties. This Privacy Policy applies to TrainingMask's use of personal information, but does not apply to the activities of any third-party. If you disclose personal information to others, whether as a result of any transaction on the Application or via the Services, or ad-click, or otherwise, their privacy policies and practices will apply. TrainingMask shall not be liable or in any way otherwise responsible for any use of personal information by such third-parties.

Mobile Terms of Service

The TrainingMask mobile message service (the "Service") is operated by TrainingMask (“TrainingMask”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to TrainingMask’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of TrainingMask through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program to make any purchases, and your consent is not a condition of any purchase with TrainingMask. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device unless initiated by you. If you have subscribed to other TrainingMask mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received, and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
